These Terms of Service govern your access to and use of FlashSync AI, operated by ISF Consultant & Business Solutions. Please read these terms carefully before creating an account or connecting your WhatsApp Business Account.
1. Acceptance of Terms
By creating an account, accessing, or using FlashSync AI, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you are entering into these Terms on behalf of a business, company, or legal entity, you represent and warrant that you have full authority to bind that entity.
2. Description of FlashSync AI
FlashSync AI is a Software-as-a-Service (SaaS) business messaging automation engine. FlashSync AI provides multi-agent live chat, AI-driven customer response automation, lead handling, order notification workflows, and CRM integrations for businesses operating on Meta's WhatsApp Business Platform.
3. Eligibility
To use FlashSync AI, you must be a legally registered business or authorized representative aged 18 or older. By registering, you confirm that your use of the service complies with all laws and regulations applicable to your jurisdiction.
4. Business Accounts
Customers are responsible for maintaining the confidentiality of their login credentials, passwords, and API keys. You are fully responsible for all activity conducted under your account.
- You must provide accurate and complete account registration details.
- You agree to notify us immediately of any unauthorized account access or security breach.
5. WhatsApp Business Platform Integration
FlashSync AI connects to Meta's WhatsApp Business Platform via official Meta Graph APIs using requested permissions such as whatsapp_business_messaging and whatsapp_business_management. FlashSync AI is an independent SaaS automation platform and is not owned, operated, or endorsed by Meta Platforms, Inc.
6. WhatsApp Business Platform Requirements
Customers using WhatsApp messaging features are solely responsible for complying with applicable WhatsApp Business Platform terms, messaging rules, user opt-in/consent requirements, and relevant telecommunication laws.
Meta and WhatsApp are third-party platforms. FlashSync AI is operated independently by ISF Consultant & Business Solutions and is not owned, endorsed, or certified by Meta or WhatsApp.
8. Prohibited Use
You explicitly agree NOT to engage in any of the following prohibited activities:
- Sending spam, unsolicited promotional messages, or bulk messaging without valid opt-in consent.
- Transmitting illegal, fraudulent, harassing, defamatory, or harmful content.
- Attempting to reverse-engineer, decompile, or compromise the FlashSync AI platform.
- Using automated scripts to scrape or overload platform API endpoints.
- Violating any applicable Meta WhatsApp Business usage policies or local telecommunication laws.
9. AI-Generated Responses
FlashSync AI offers AI-assisted drafting and automated reply capabilities. Customers are responsible for configuring, testing, and reviewing AI bot logic and response templates. FlashSync AI is not liable for errors, misstatements, or unintended outputs generated by AI components operating under your configuration.
10. Customer Responsibilities
Businesses using FlashSync AI are solely responsible for obtaining necessary opt-in consent from end-user recipients prior to sending WhatsApp messages, honoring customer opt-out requests, and ensuring compliance with regional privacy laws (e.g. TCPA, GDPR, local consumer protection regulations).
11. Message Content and Customer Data
You retain full ownership of all message content, media, and customer contact data uploaded or processed through your FlashSync AI account. You grant FlashSync AI a limited, non-exclusive license to process your data solely to deliver SaaS platform features.
12. Third-Party Services
FlashSync AI relies on third-party infrastructure, including Meta Graph APIs, server hosting, and AI engine providers. We are not responsible for service outages, policy enforcement, or API modifications imposed by third-party service providers.
13. Fees and Subscriptions
Access to FlashSync AI features is provided according to the subscription tier selected by the customer. Fees are payable in advance on a recurring monthly or annual basis as specified during subscription setup. All fees are non-refundable unless explicitly stated otherwise.
14. Suspension and Termination
We reserve the right to suspend or terminate your access to FlashSync AI immediately, without prior notice, if you breach these Terms, engage in fraudulent activity, or violate Meta platform policies. You may terminate your account at any time via dashboard settings or support request.
15. Intellectual Property
FlashSync AI, including software source code, user interface designs, logos, and trademarks, is the exclusive intellectual property of ISF Consultant & Business Solutions. Nothing in these terms transfers ownership of any intellectual property rights to you.
16. Confidentiality
Each party agrees to protect the confidential information of the other party with reasonable care and not disclose such information to third parties except as permitted under these Terms or required by law.
17. Service Availability
While we endeavor to provide high service uptime, FlashSync AI is provided on an "as-is" and "as-available" basis. We do not guarantee uninterrupted operational availability or zero error rates during emergency maintenance or third-party API outages.
18. Disclaimer of Warranties
To the maximum extent permitted by law, FlashSync AI and ISF Consultant & Business Solutions disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
19. Limitation of Liability
In no event shall ISF Consultant & Business Solutions or FlashSync AI be liable for indirect, incidental, consequential, special, or punitive damages arising out of your use or inability to use the platform. Our total aggregate liability shall not exceed the amounts paid by you to FlashSync AI in the three (3) months preceding the claim.
20. Indemnification
You agree to defend, indemnify, and hold harmless ISF Consultant & Business Solutions, its officers, employees, and agents from any claims, damages, liabilities, and expenses arising from your violation of these Terms, inappropriate message content, or non-compliance with Meta policies.
21. Changes to the Service
We continuously update FlashSync AI to improve features and functionality. We reserve the right to modify, add, or discontinue features with reasonable notice where feasible.
22. Changes to Terms
We may modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Continued use of the platform following modifications constitutes acceptance of the updated Terms.
23. Governing Law
These Terms are governed by and construed in accordance with applicable commercial and business laws. Any legal disputes arising out of or in connection with these Terms shall be resolved in the competent courts of jurisdiction representing ISF Consultant & Business Solutions.
